Artificial Intelligence (AI) Policy

Trident Health Law, LLC is committed to the responsible, ethical, and transparent use of artificial intelligence (AI) technologies in support of our legal services, operations, and client relationships. This policy outlines how we use AI, the safeguards we apply, and the professional standards that guide our approach.

1. Purpose and Scope

This policy applies to all attorneys, staff, contractors, and vendors who use or interact with AI tools in the course of Trident’s business. It governs the use of AI in legal research, document handling, client communications, operational support, and other firm activities.

2. Definition of AI

Artificial Intelligence (AI) refers to technologies that perform tasks typically requiring human intelligence, including but not limited to:

  • Natural language processing
  • Machine learning
  • Predictive analytics
  • Generative AI (e.g., large language models)

3. Use of AI at Trident

Trident may use AI tools to:

  • Accelerate legal research and document review
  • Summarize statutes, regulations, or case law
  • Assist in drafting internal materials (subject to attorney review)
  • Support operational functions such as scheduling and intake
  • Analyze healthcare compliance trends and data

AI tools are used to enhance—not replace—attorney judgment, legal analysis, or client decision-making.

4. Human Oversight

All outputs generated by AI are reviewed and validated by qualified attorneys or staff. AI is not used to provide legal advice, make final determinations in client matters, or substitute for professional legal analysis.

5. Confidentiality and Data Protection

Trident does not input client-identifiable information, protected health information (PHI), or sensitive legal data into public or unsecured AI platforms.

All AI tools used by the firm must:

  • Meet Trident’s internal data security standards
  • Comply with applicable privacy laws and contractual obligations
  • Be vetted for secure data handling and retention practices

6. Vendor Due Diligence

AI vendors and platforms are evaluated for:

  • Data retention and deletion policies
  • Encryption and access controls
  • Breach response protocols
  • Transparency of decision-making processes

Trident documents all vendor communications and retains copies of relevant privacy and security policies.

7. Disclosure to Clients

Trident attorneys will disclose the use of AI tools in client matters where relevant, including:

  • The objective of AI use
  • Anticipated costs and benefits
  • Potential risks and limitations
  • Data security considerations

Clients may request that AI not be used in their matters. Trident will honor such requests where feasible and appropriate.

8. Preservation of AI Work Product

AI-generated documents, summaries, or analyses used in client matters are considered part of the client file and will be preserved in accordance with Trident’s recordkeeping policies and applicable professional standards.

9. Professional Responsibility

Trident Health Law’s use of AI technologies is governed by the professional obligations of our attorneys under applicable rules of professional conduct. These include duties of competence, confidentiality, communication, supervision, and truthfulness.

All AI-assisted work is supervised by licensed attorneys to ensure compliance with these standards and to protect the integrity of our legal services.

10. Risk Management and “Black Box” AI

Trident does not rely on AI systems whose decision-making processes are opaque or proprietary (“black box” AI) without documented review and validation. Attorneys must assess whether AI outputs are:

  • Accurate and defensible
  • Coherent and consistent
  • Free from bias or misinformation

11. Monitoring and Governance

Trident maintains internal governance protocols to:

  • Monitor AI usage and compliance
  • Conduct periodic audits and reviews
  • Train attorneys and staff on ethical AI use
  • Document all human inputs and AI outputs

12. Court-Specific Disclosure Requirements

Trident attorneys will comply with any court orders requiring disclosure or certification of AI use in filings. This includes verifying all citations and ensuring no confidential information is disclosed through AI platforms.

13. External Standards and Frameworks

Trident’s AI practices are informed by leading frameworks and guidance, including:

  • NIST AI Risk Management Framework
  • ISO/IEC 42001 AI Management System Standard
  • White House Blueprint for an AI Bill of Rights
  • FTC AI Guidelines
  • ABA Resolutions and commentary on AI ethics

14. Policy Review and Updates

This policy is reviewed annually and updated as needed to reflect changes in law, technology, and professional standards.
